These Terms of Use (“Terms”) govern your access to and use of upstateevents.co (the “Site”), operated by Upstate Events (“we,” “us,” “our”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
The service
Upstate Events is an event discovery site for New York's Capital Region. We aggregate event information from venue websites, ticketing platforms, public sources, and user submissions, and we publish editorial guides. Listings are provided for general informational purposes only.
Accuracy of listings
We work to keep listings accurate, but event details (dates, times, prices, availability, age restrictions, cancellations) are set by venues and organizers and can change without notice. Always confirm details directly with the venue or organizer before traveling, purchasing tickets, or making plans.
Event submissions
When you submit an event through our submission form or by email, you represent that the information is accurate and that you have the right to share it. You grant us a non-exclusive, royalty-free, worldwide license to publish, edit, format, and distribute the submitted information on the Site and in related communications (such as our newsletter and social media).
We may decline, edit, or remove submissions at our discretion. Submission does not guarantee publication.
Acceptable use
You agree not to:
- Use the Site to violate any law or the rights of others.
- Scrape, harvest, or copy listings in bulk without our written permission.
- Submit false, misleading, infringing, or unlawful content.
- Interfere with the Site's operation or attempt to gain unauthorized access.
- Use the Site to send spam, malware, or harassing communications.
Third-party links and venues
The Site contains links to third-party websites, including venues, ticket sellers, and organizers. We do not control these sites and are not responsible for their content, products, services, pricing, or privacy practices. Tickets and admission are sold by the third parties listed; any transaction is between you and that third party.
Intellectual property
The Upstate Events name, logo, editorial content, guides, and the arrangement and curation of listings on the Site are owned by us and protected by applicable laws. You may view and share individual listings for personal, non-commercial purposes. All other use requires our prior written consent.
Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE COMPLETE, ACCURATE, OR CURRENT, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UPSTATE EVENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY EVENT YOU LEARNED ABOUT THROUGH THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Indemnification
You agree to indemnify and hold harmless Upstate Events and its operators from any claim or demand, including reasonable attorneys' fees, arising from your use of the Site, your submissions, or your violation of these Terms.
Changes to the Site and these Terms
We may modify the Site or these Terms at any time. When we update the Terms we will revise the “Effective” date above. Your continued use after changes are posted means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Albany County, New York, and you consent to their jurisdiction.
